Perfect Corp. (hereinafter referred to as “the Company” or “We”) knows very well how important your personal information is (that is, the end user’s). We shall make all-out effort to keep your personal information safe and reliable. We are committed to retaining your trust to us by abiding the following principles to protect your personal information: parity of authority and responsibility principle, goal-oriented principle, choice-and-consent principle, minimization and necessity principle, security ensuring principle, principle of subject participation and principle of openness and transparency etc. In this privacy policy, we shall demonstrate how we collect, use, share and protect your personal information when you use the Native SDK, WeChat, Mini SDK and Taobao Mini SDK provided by us (collectively known as “the Service”). We also illustrate how you can contact us if you have any questions or suggestions towards this privacy policy. Before using our service, please read carefully and understand this privacy policy.

Special Instructions:

  1. This privacy policy is applicable for the circumstances when we collect and process your personal information through our service. Nevertheless, we do not control how the developer (the one who developed the application you’re currently using) collects and uses your personal information and we are not responsible for their behaviors. We suggest that you carefully read the user agreement and privacy policy from the developer.

  2. In terms of assisting with the processing activity of your personal information within the service range offered by the developer, we who serve as the assignee of the developer process your personal information by strictly following the instructions of the developer and the statutory and regulatory requirements. In terms of the processing activity beyond the range mentioned above, we shall proceed on the premise that you agree with it or with other legal basis as well as with solid promises to secure your personal information and related rights.

  3. Developer’s obligation:

            • Click-stream data
            • The information about your device, including the device type and operation system.
          • (2) When you use the function of virtual color testing on photo, we will need you to provide your personal photo to perform the function of color testing on photos. Besides, we shall collect the following information so as to offer you premium color testing service which meets your requirements:
            • The information of products tested and saved while using color testing on photo.
          • (3) When you use the function of real-time virtual color testing, we will need to get the permission to use your camera. Besides, we shall collect the following information so as to offer you premium color testing service which meets your requirements:
            • The information of products tested, photographed and saved while using real-time color testing.
          • (4) When you use the function of skin analyzer, we will get the permission to use your camera. Besides, we shall collect the following information so as to offer you premium skin analyzer service which meets your requirements:
            • The use behaviors on the skin analyzer page are inclusive of page opening and analysis completion as well as the recommended product information after analyzing.
          • (5) When you use the function of skin color analyzer, we shall get the permission to use your camera. Besides, we shall collect the following information so as to offer you premium skin color analyzer service which meets your requirements:

      2. (B) WeChat Mini SDK
        1. In order to offer premium user experience and strengthen the security when you use WeChat Mini SDK, the following information are automatically processed according to the laws and regulations, including:

        2. When you use WeChat Mini SDK:
          1. (1) To offer premium user experience, we shall collect and automatically transmit the following technical information of your devices on the premises that we obey the laws and regulations:

    2. Exception

      You understand and agree that the functions and services offered by us is subject to periodical updates. If we haven’t explicated the scenarios that we need to collect and use your personal information as per the above, we shall otherwise explain the content, range and purpose of the information collection and secure your agreement by the ways of pop-ups, interactive process and public announcement on the website. According to the applicable laws and regulations, it’s not necessary to get your agreement to collect and process your information under the following circumstances.

    3. After we take technical or other necessary measures to process your personal information, the data recipient can’t re-recognize particular person nor recover the information. It’s not required to otherwise advise you or get your agreement to share, transfer or disclose the information after processed according to the applicable law.
      We shall collect your personal information and use it for the following purposes based on this privacy policy:
      1. to offer you the Service.
      2. to maintain and improve the functions of the Service and to develop new functions etc.

      We shall cope with your personal information in a cautious and confidential way. Unless with your agreement or with the legality regulated by other laws and regulations, we shall not share your personal information with any third party.

Our affiliated Company: To easily use our service, after receiving your agreement and authorization your personal information shall be shared with our affiliated company bound by the purposes claimed in this policy. If we share the sensitive personal information of yours or the affiliated company may change the usage or processing purpose of the personal information, we shall seek for your individual consent or authorization again. The share is only confined to the purpose range formulated in this privacy policy. Besides, the affiliated company shall conform to the related regulations of information security in accordance with our instructions (including but not limited to the compliance with this privacy policy).
      2. According to the laws and regulations, the requirements to resolve litigation disputes, or the legal requirements proposed by judicial authority, we shall share your personal information with the competent authority with due legal process.

      We shall not transfer your personal information to any company, organization or individual, but the following circumstances are excluded:

  • How We Protect and Store Your Personal Information
    1. (A) Protect Your Personal Information
      1. We have taken the security and safeguard measures conforming to de facto standards to prevent the data from access, disclosure, usage, revision, damage or loss without authorization. We shall take all the reasonable and feasible measures to protect your personal information.
      2. In case of any incident regarding the security of personal information, we shall notify you promptly based on the requirements of laws and regulations about: the basic condition of the security incident and the possible influence, the measures we have taken or are about to take, the suggestions for your self-defense and risk reductions as well as the mitigation measures for you. We shall promptly notify you of the relevant situation of the incident via email, mail, phone and system notice etc. When it’s difficult to notify users of the information subject one by one, we shall make a public announcement in a reasonable and effective way. In the meantime, we shall report the dispositions of security incident towards personal information according to the requirements from the supervision and regulatory department.

We shall take all kinds of security and safeguard measures to protect your personal information under reasonable circumstances, including but not limited to storage encryption, transmission encryption (such as SSL), access control, delabeling and anonymous processing. We shall take use of TSL Agreement to encrypt the information entered during the transmission process, trying our utmost to protect the security of your information. You ought to avoid the access password or mobile device without authorization. Also, please log out after using shared mobile device.

    2. (B) Storage Period

      Your personal shall be stored within the shortest term required for using the Service according to the applicable laws. Unless the law requires to store your personal information for a longer term, at the expiry of the term mentioned above your personal information shall be automatically deleted or processed with anonymization.

    3. (C) Storage Location

      Your personal information will be stored in our cloud server established on Amazon Web Services (AWS) located in Japan, your information may be transferred to Japan and other countries to be processed by us or our service providers in order to provide the Service to you or for such other purposes as set forth in this policy. For localized Service acceleration purposes, we may also store and process your information on AWS located in another country than Japan. You hereby consent and agree that we may collect, process, use, and store your information, as discussed in this policy, outside your resident jurisdiction. Please be aware that the laws of other countries where we process your information may offer different levels of protection for information than may be available in your country. However, if your information is shared or transferred as described in this policy, we will seek assurances from the recipients of such information (prior to the transfer) that they will safeguard the information in a manner consistent with this policy. We ask recipients of such information to enter into a contractual relationship with us that includes confidentiality and non-disclosure clauses, and provides the same level of commitment to and protections of information as provided in this policy.

  • Your Rights
    1. (A) Inquire Your Personal Information

      You have the right to inquire your personal information associated with our service.

    2. (B) Change Your Personal Information

      When you find any mistakes in the personal information collected and saved or when it’s required to be updated, you have the right to change it.

    3. (C) Delete Your Personal Information

      When the following circumstances occur, you shall request that we delete your personal information:

      1. we didn’t get the express consent from you but collected your personal information. Or you withdraw your consent to our processing of your personal information.
      2. Our processing of your personal information violates the laws and regulations.
      3. Our processing and using of your personal information violate our promises to you.
      4. You don’t use our product or service anymore. Or your account is cancelled, and the storage period of personal information has expired.
      5. We no longer provide you with our products or services, and the storage period of personal information has expired.

    4. (D) Transfer Your Personal Information

      You have the right to ask us to transfer your personal information to a third party of personal information processor.

    5. (E) Withdraw Your Agreement and Authorization

      You have the right to withdraw your agreement and authorization. Once withdrawing your authorization and agreement, we can’t continue to offer the corresponding services once agreed before your withdrawals of the authorization. However, your decision to withdraw the agreement won’t influence previous development of personal information processing on the basis of your authorization.

    6. (F) Obtain a Copy of Your Personal Information

      You have the right to obtain a copy of your personal information.
      In terms of the request for the inquiry, change, deletion and withdrawal of your authorization and the cancellation of your account as mentioned above, you are required to offer a written request to ensure the security, or required to prove your identity in other ways. We shall make a response to it within a reasonable period.
      We can’t respond to your request under the following circumstances:

      1. it’s related to the obligations of the personal information controller regulated by the laws.
      2. it’s directly related to the national security and national defense.
      3. it’s directly related to the public safety, public hygiene and significant public interests.
      4. it’s directly related to criminal investigation, prosecution, trial and enforcement of judgement etc.
      5. the controller of the personal information has abundant evidence to prove that the entity of the personal information contains malicious intent or abuse of rights.
      6. it aims at protecting the entity of the personal information or the lives and assets of other individuals, but relatively difficult to obtain the agreement from the individual.
      7. the response to the request of the entity of the personal information results in serious damage. to the legal interests of the entity, other individuals or organizations.
      8. it involves in commercial confidential information.
      Except for the rights mentioned above, you enjoy the rights of decision, restriction, refusal and automatic decision making. You shall propose the request for your rights by sending email to privacyteam@perfectcorp.com. We shall respond to your request for rights within fifteen working days.

  • The Update of This Privacy Policy

    We may revise this policy from time to time. We shall notify you of the revised content by arranging it on the prominently publicized location on the page. Under this circumstance, your continuous usage of our service expresses your consent to be bound by the revised policy. In the meantime you agree us to collect, use, store, share and transfer the information about you according to this privacy policy.
